AGO Summons Setya in Freeport Case

The Attorney Generals Office (AGO) has said that it would grill former House of Representatives speaker Setya Novanto on Wednesday in its investigation into the alleged abuse of power and conspiracy to demand shares in gold and copper mining firm PT Freeport Indonesia.
AGO junior attorney for special crimes Arminsyah said the AGO had sent Setya a summons letter on Friday requesting his attendance at a questioning on Wednesday.
So far, we havent heard back from him regarding his confirmation of attendance. We will most likely hear from him tomorrow, Arminsyah told The Jakarta Post on Sunday.
Arminsyah said that the AGO decided to summon the Golkar Party politician after being told by House secretary-general Winantuningtyastiti Swasanani that Setyas meeting with Freeport president director Maroef Sjamsoeddin, at which he allegedly demanded the shares, was unrelated with his official duties as House speaker.
Setya allegedly offered to help the company secure a work contract extension from the government in exchange for the shares.
We dont need approval from President [Joko Jokowi Widodo] [to question Setya]. Because the secretary general has said that he did not attend the meeting in an official capacity as a member of the House, Arminsyah added.
Setyas lawyer Rudy Alfonso lambasted the AGO for issuing the summons letter before receiving approval from Jokowi.
It was the AGO that previously asked the President to approve summoning my client, but why did the AGO change its mind while still waiting for that approval. This is clearly disrespectful toward the President, Rudy told the Post on Sunday.
The Legislative Institutions (MD3) Law stipulates that law enforcement organizations must obtain permission from the President before questioning lawmakers in general crime cases. However, the law does not require investigators to obtain permission in cases related to corruption, which is considered an extraordinary crime.
The AGO has already been investigating Setya for two months but it has yet to declare him a suspect.
Setya allegedly claimed to have won the approval of Jokowi and Vice President Jusuf Kalla to secure shares and projects from Freeport Indonesia in exchange for helping the firm extend its contract and continue operating its gold mine, one of the worlds largest, in Papua.
Even if it cannot be proved that Setya benefited in any way, if the alleged violation is proved to have occurred, he could be charged with corruption under Article 15 of the corruption law, which mandates punishment for individuals who attempt, help or plan a corruption scheme.
In addition, if found guilty the AGO could also charge Setya under Article 2 and 3 of the same law for state officials who abuse their power to benefit themselves, other people and corporations, as part of corrupt practices that cause state losses.
